1. About WhiskList

WhiskList is a marketplace and technology platform that connects local home cooks and bakers with people who want to buy homemade goods. We provide software and tools for cooks to set up kitchens, schedule cook dates, manage orders, and collect payments—and for customers to browse, order, and pick up.

WhiskList is not a restaurant, food service establishment, catering business, or food producer. We do not prepare, store, deliver, or sell food. We do not operate kitchens or produce food products. We provide technology only. We give cooks a platform to share their creations; we do not bake, cook, or produce goods ourselves, and we do not supervise or control the cooks.

2. Cook Accountability

Cooks who use WhiskList are independent operators. They are solely responsible for:

• Food safety and hygiene in their kitchens
• Compliance with cottage food laws, health permits, and food labeling requirements
• Accurate disclosure of allergens and dietary information
• Accuracy of product descriptions and ingredients
• The quality, safety, legality, and delivery of goods they sell

WhiskList does not inspect or certify kitchens. We do not verify that cooks comply with applicable laws or that their products are safe or accurately described. Cooks are responsible for their own compliance.

3. Customer Acknowledgments

By using WhiskList, you acknowledge and agree that:

• You are purchasing homemade food that may not be prepared in a commercial kitchen
• You are responsible for reviewing product descriptions and asking cooks about allergens or ingredients before ordering
• You order at your own risk

4. Limitation of Liability

WhiskList is not liable for:

• The quality, safety, legality, or delivery of goods sold on the platform
• Any damages resulting from your use of the platform or your interactions with cooks or other users
• Any illness, injury, or loss arising from food prepared, sold, or delivered by cooks

We provide the platform "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability for any claim arising out of or related to these Terms or your use of WhiskList shall not exceed the amount you paid to WhiskList in the twelve (12) months preceding the claim.

5. Indemnification

You agree to indemnify, defend, and hold harmless WhiskList and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your conduct or content; (c) any food you prepare, sell, or deliver (if you are a cook) or any food you purchase (if you are a customer); or (d) your violation of these Terms or any applicable law.

6. Orders and Disputes

When you place an order, you enter into a direct agreement with the cook. Cooks are responsible for managing pickup or delivery logistics, setting and displaying pricing, and preparing and packaging food. Once an order is confirmed, changes and cancellations are at the cook's discretion.

Order disputes are primarily between you and the cook. If you have an issue with an order, contact the cook first. If you cannot resolve it, you may contact us at support@whisklist.club. We may attempt to assist, but we do not guarantee refunds or specific outcomes.

7. Payments

Payments are processed securely through our third-party provider (Stripe). We do not store your full payment information. Cooks receive payments through Stripe Connect. Refunds, when applicable, are handled in accordance with our refund policy and Stripe's terms.

8. Content and Reviews

You may leave reviews or upload content through the platform. By doing so, you grant WhiskList a non-exclusive, royalty-free license to display and use that content. We may remove content that is abusive, discriminatory, irrelevant, or violates these Terms.

9. Prohibited Uses

You agree not to:

• Harass cooks or other users
• Attempt to scrape, hack, or disrupt the platform
• Impersonate others or misrepresent your identity
• Use WhiskList for illegal purposes
• Violate any applicable laws or regulations

We may suspend or terminate accounts that violate these Terms.

10. Changes

We may update these Terms from time to time. If we make material changes, we will notify you (via platform notice, email, or both). Continued use of WhiskList after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which WhiskList operates, without regard to conflict of law principles.
